Privacy Policy

1. Introduction

This Privacy Policy explains how Foundly Labs Pty Ltd ("Company," "we," "us," or "our"), an Australian company, collects, uses, discloses, and protects your personal information when you use Warptown (the "Game" or "Service"), including all associated websites, applications, and services.

By using the Game, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Game.

This Privacy Policy should be read together with our Terms of Service.

2. Information We Collect

2.1 Account Information

When you create an account, we collect information from your chosen authentication provider, which may include:

  • Farcaster: Farcaster ID (FID), username, display name, profile picture, verified addresses, and profile information
  • Telegram: Telegram user ID, username, first name, last name, and profile picture
  • Wallet: Blockchain wallet address and associated verification data

2.2 Profile and Character Data

As you use the Game, we collect:

  • Character customization choices (appearance, equipment, clothing)
  • Game settings and preferences (audio, video, controls, keybinds)
  • Account flags and status

2.3 Gameplay Data

We collect data about your gameplay, including:

  • In-game location and position within game worlds
  • Items, inventory, and equipment
  • Skills, levels, and progression
  • Achievements and milestones

2.4 Communication Data

When you use communication features, we collect:

  • Chat messages sent in public channels (General, Trade)
  • Direct messages between players
  • Usernames and display names visible to other players

Note: Chat messages may be moderated and can be hidden or removed if they violate our Terms of Service.

2.5 Transaction Data

When you make purchases, we collect:

  • Transaction amounts and currency used
  • Items purchased
  • Transaction status and timestamps
  • For cryptocurrency payments: wallet addresses and transaction hashes
  • For card payments: payment confirmation (we do not store full card details)

2.6 Technical Data

We automatically collect certain technical information:

  • Device type and operating system
  • Browser type and version
  • IP address
  • Session information
  • Error logs and crash reports for performance monitoring

2.7 Notification Data

If you enable notifications, we collect:

  • Push notification tokens
  • Notification preferences

6.1 Active Accounts

We retain your personal information for as long as your account remains active and as needed to provide you with the Service.

6.2 Account Deletion

When you request account deletion:

  • Personal data (account information, character data, chat messages, settings) will be deleted within a reasonable timeframe
  • Transaction records will be anonymized and retained for legal and financial compliance purposes (tax records, fraud prevention)
  • Aggregated, non-identifying data may be retained for analytics purposes

We may retain certain information longer if required by law or to protect our legal interests.

8.2 Exercising Your Rights

To exercise any of these rights, please contact us through our in-game support. We will respond to your request within a reasonable timeframe and in accordance with applicable law.

8.3 Account Deletion

You may request deletion of your account at any time. Upon deletion:

  • Your account will be deactivated
  • Personal data will be removed as described in Section 6
  • Any remaining Warp Gems will be forfeited (no refunds)
  • This action cannot be undone

9. Rights for EU/EEA Users (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR):

9.1 Your GDPR Rights

  • Right of Access (Article 15): Obtain confirmation of whether we process your data and access to that data
  • Right to Rectification (Article 16): Correct inaccurate personal data
  • Right to Erasure (Article 17): Request deletion of your personal data ("right to be forgotten")
  • Right to Restriction (Article 18): Restrict processing of your personal data

9.2 Automated Decision-Making

We do not use automated decision-making or profiling that produces legal effects or similarly significantly affects you.

Your data may be transferred to and processed in countries outside the EEA, including Australia. When we transfer data outside the EEA, we ensure appropriate safeguards are in place, such as:

  • Standard Contractual Clauses approved by the European Commission

10. Children's Privacy

The Game is not intended for users under the age of 16. We do not knowingly collect personal information from children under 16.

If we become aware that we have collected personal information from a child under 16, we will take steps to delete that information and terminate the associated account.

If you believe a child under 16 has provided us with personal information, please contact us through our in-game support.

11. Cookies and Similar Technologies

13. International Data Transfers

We are based in Australia. Your information may be transferred to, stored, and processed in Australia and other countries where our service providers operate.

By using the Game, you consent to the transfer of your information to countries outside your country of residence, which may have different data protection laws.

We may update this Privacy Policy from time to time. Changes will be posted with a new "Last Updated" date. Material changes may be communicated through in-game notifications or email (if provided).

Your continued use of the Game after changes are posted constitutes acceptance of the updated Privacy Policy.
